Conditions of Sale & Trading
The terms that apply to every order and in-store purchase.
1. General
1.1 The following Conditions of Sale shall apply to all contracts between Trident Tiles Ltd. ("the Company") and a customer of the Company ("the Customer"), to the exclusion of any other terms, representations, conditions, or warranties. The Customer shall be deemed to have accepted these Conditions of Sale upon placing an order or making a cash purchase from the Company.
1.2 These Conditions of Sale may not be varied except by the express written agreement of the Company.
1.3 In the event of the Customer's official order form containing any special conditions, it is understood that such conditions are only binding insofar as they are not inconsistent with the Company's Conditions of Sale or are specifically accepted by the Company in writing.
2. Delivery
2.1 Orders are accepted and arrangements for delivery are made subject to availability. No liability can be accepted for delays arising from manufacturing risks and uncertainties, strikes, accidents, or other factors beyond the Company's control.
2.2 Any arrangements made by the Customer in anticipation of delivery are made entirely at the Customer's own risk.
3. Passing of Risk
3.1 The risk in the goods shall pass to the Customer upon collection or delivery.
4. Property / Title
4.1 Until payment in full has been received by the Company, title to the goods shall remain with the Company and shall not pass to the Customer.
5. Cancellations / Variations
5.1 The Company reserves the right to refuse cancellation of orders where goods have been despatched, are ready for despatch, or are in the process of manufacture.
5.2 The return of goods specially ordered for the Customer cannot be accepted unless they are found to be defective in quality, description, or performance in accordance with your legal rights. The return of stock items within 28 days of purchase will normally be accepted, provided they are in good condition and of a shade compatible with current shelf stock, subject to a restocking charge of 30% of the purchase price or £10.00, whichever is greater.
5.3 The Company reserves the right to discontinue any product without prior notice, and no liability can be accepted for costs incurred by the Customer due to the inability to supply such products.
6. Loss / Damage
6.1 The Customer shall be deemed to have examined all goods within 48 hours of collection or delivery and to be satisfied that the goods are undamaged, of the correct quantity, and in accordance with the contract unless notification to the contrary is received by the Company within that period.
6.2 No liability will be accepted for any other complaint unless it is made within 7 days of delivery. In any event, no claims may be made after the tiles have been fixed.
7. Exclusions
7.1 Any advice, opinion, representation, or information given by or on behalf of the Company is provided as guidance only. Without limiting the generality of the foregoing, any advice or assistance of any nature relating to the installation, use, or performance of any goods supplied by the Company shall not be binding upon the Company unless expressly stated in writing to be incorporated into the contract.
7.2 Shade variation is an inherent part of the manufacture of ceramic tiles and associated products, particularly those with decorative effects. Accordingly:
- Goods are sold subject to the shade variations normally experienced in these products.
- It is important to ensure that an acceptable blend of shades has been achieved before the goods are fixed. No liability in respect of shade variation will be accepted after the goods have been fixed.
- Goods supplied may not precisely match the shade of sample materials.
- No responsibility will be accepted for staining caused by coloured grouts.
7.3 No tiles are guaranteed against crazing.
7.4 The supply of goods does not constitute a warranty that they are suitable for any specific installation.
